I. HOW TO ENTER
NO ENTRY FEE. NO PURCHASE OR OBLIGATION NECESSARY TO PLAY OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Entry deadline is April 10, 2005.

You may enter the Sweepstakes in one of two ways:

  1. To enter online, set up a sweepstakes account at http://xenosaga2.namco.com by submitting your email address, date of birth, and user ID. When you find and collect all 12 pieces of “Y-data” located at http://xenosaga2.namco.com you will automatically be entered to win. You may also enter by setting up a sweepstakes account and correctly entering codes found in Xenosaga EPISODE II print ads, online promotions and games into the ‘Enter Code' box on the Xenosaga EPISODE II homepage. When you find a five-digit alphanumeric entry code in Xenosaga EPISODE II print ads, online promotions and games, login to your sweepstakes account, enter your code, and you will automatically be entered to win. For each unique alphanumeric entry code, you will be entered into the drawing once. Limit one sweepstakes account per person. Limit one prize per person. The sweepstakes will commence on January 11, 2005 on or around 11:59 AM Pacific Time) . Entries must be received by Namco Hometek, Inc. no later than 11:59 PM (Pacific Time) on April 10, 2005 .   

    Each entrant in the sweepstakes must be the rightful owner or have authorized use of the e-mail account indicated by the entrant's e-mail address. In the event of a dispute concerning the identity of the winner submitting an entry, the winner will be deemed to be the person in whose name the e-mail account is opened. The e-mail account must be opened prior to the commencement of the sweepstakes. Use of a false email account will disqualify an entry. The use of scripts or any automated system to enter is strictly prohibited. Sponsor, in its sole discretion, reserves the right to disqualify any person who, tampers with the entry process or the operation of the web site, or who otherwise violates these rules. By entering, entrants accept and agree to abide by the terms of these Official Rules and Conditions.

  2. To enter by mail without obligation, hand-write your name, mailing address, phone number and date of birth on a 4"x6" card and mail to: Xenosaga EPISODE II iPod Sweepstakes, Namco Hometek Inc., 4555 Great America Parkway, Suite 201, Santa Clara, CA 95054. Mail-in entries must be postmarked by April 9, 2005, and be received by April 16, 2005.

II. ELIGIBILITY
Open to all legal residents of the United States only (excluding Guam, Puerto Rico and all other U.S. territories and possessions), age 13 or older. Individuals under 18 years of age must have the permission of a parent or legal guardian to enter. All federal, state, and local laws and regulations apply. Void where prohibited or restricted by law. Employees of Namco Hometek, Inc., their respective sponsored affiliates, vendors, clients, and their immediate family members are not eligible to enter this sweepstakes. Entrants residing outside of the qualified area, or those deemed to have used false information will be automatically disqualified.

III. PRIZES
There will be a total of three different prizes and seventeen (17) possible winners selected. The odds of winning a prize will depend on the number of eligible entries received. Winners will receive one of the following prizes, selected randomly:
  1. Grand Prize: 20GB Apple iPod and Official Japanese Soundtrack (2)
  2. 2nd Prize: Official Japanese Soundtrack (5)
  3. Third Prize: Xenosaga EPISODE II Strategy Guide (10)
Total value of all prizes is $1,200.00. Prizes cannot be exchanged for cash. Please allow 6 to 8 weeks for shipping. NAMCO HOMETEK, INC. RESERVES THE RIGHT TO SUBSTITUTE PRIZES OF EQUAL OR GREATER VALUE, AS STATED ABOVE, FOR ANY REASON.

IV. WINNERS
Odds of winning will depend on qualified entries. Winners will be selected in a random drawing on April 18, 2005 and notified by May 1, 2005 if they have won a prize. U.S. Prize winners under the age of 18 will require parental written permission, received no later than 72 hours after notification, to remain eligible for the sweepstakes. A noncompliance within that time period or the return of any notification as undeliverable will result in disqualification and the selection of an alternate winner. In the event of any other noncompliance with rules and conditions, prize may be forfeited and an alternate Winner will be randomly selected from the remaining valid, eligible entries. Taxes, if any, are the winner’s sole responsibility. By participating, entrants agree to be bound by the official rules and the decision of the judges which shall be binding and final in all respects. Prizes that are not claimed by May 31, 2005 will become the property of Namco Hometek, Inc.

V. RESERVATIONS
By participating, Winner (and Winner’s parent/legal guardian) agrees that Namco Hometek, Inc., their respective assigns, subsidiaries, affiliates, advertising, promotion and fulfillment agencies will have no liability whatsoever, and will be held harmless by Winner (and Winner’s parent/legal guardian) for any liability, for any injuries, losses, or damages of any kind to person, including death, and property resulting in whole or in part, directly or indirectly, from the acceptance, possession, misuse, or use of the prize, or participation in this sweepstakes. All entrants agree to be bound by these rules and the results of the random selection of the winners, which shall be final, and waive any right to claim ambiguity in the sweepstakes and/or these rules.

Namco Hometek, Inc. assumes no responsibility for lost, late, damaged, mutilated, misdirected, incomplete, altered, illegible or postage due entries or requests or for any computer, telephone, or electronic hardware, programming or software malfunctions, or failures, or line connections, accessibility or availability, or technical failures of any kind, or unauthorized human intervention, or the incorrect or inaccurate capture of any entry or other information, or for the failure to capture any such information. If, for any reason, the sweepstakes is not capable of running as planned by reason of infection by virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of Namco Hometek Inc,, may corrupt or affect the administration, security, fairness, integrity or proper conduct of this sweepstakes, Namco Hometek, Inc. reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the sweepstakes, and select the winner for the sweepstakes, from the entries received prior to the action taken or in other such manner as deemed fair and appropriate by Namco Hometek, Inc.

ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND, IN SUCH EVENT Namco Hometek, Inc RESERVES THE RIGHT TO PURSUE ITS REMEDIES AND DAMAGES (INCLUDING COSTS AND ATTORNEY'S FEES) TO THE FULLEST EXTENT OF THE LAW.

Namco Hometek, Inc. will only use the personally identifiable information obtained from the entrants in accordance with its privacy policy, which may be found at PRIVACY POLICY

By entering the sweepstakes the Winner or Winner's parent or legal guardian if the Winner is under the age of 18 consents to the use of the Winner's name, likeness, and biographical data for publicity and promotional purposes on behalf of Namco Hometek, Inc. and it's designates with no additional compensation or further permission (except where prohibited by law).
